Acceptance of These Terms
These Terms of Use ("Terms") govern your use of the Captain Calm mobile app and our website at captaincalm.co.uk (together, the "Service"), provided by Captain Calm ("we", "us", "our"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
What Captain Calm Is
Captain Calm is a mobile app that provides AI-assisted conversations and tools to help dog owners manage worry and anxiety about their dogs. It includes a free tier with usage limits and an optional paid subscription, Calm+.
Not Professional Advice
Captain Calm provides general wellbeing support and is not a substitute for professional advice:
- It is not veterinary advice. If you are concerned about your dog's physical health or behaviour, consult a qualified veterinarian or behaviourist.
- It is not medical, psychological, or mental health advice, diagnosis, or treatment for you.
- It is not a crisis or emergency service. If you or someone else is in crisis or danger, contact your local emergency services or a qualified professional immediately.
Always use your own judgement and seek professional help where appropriate.
AI-Generated Content
Responses in the app are generated by artificial intelligence. They may be inaccurate, incomplete, or not suited to your situation. We do not guarantee the accuracy, reliability, or suitability of any AI-generated content, and you rely on it at your own discretion.
Eligibility
You must be at least 13 years old and capable of forming a binding contract to use the Service. The Service is intended for adult dog owners.
Calm+ Subscriptions
Calm+ is an auto-renewable subscription. For subscriptions purchased through the Apple App Store:
- Payment is charged to your Apple ID account at confirmation of purchase.
- The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period, at the price of the selected plan.
- You can manage your subscription and turn off auto-renewal in your Apple ID account settings after purchase.
- The price and billing period of each plan are shown in the app at the point of purchase.
- If you cancel, you keep access to Calm+ until the end of the current billing period. We do not provide refunds for partial periods except where required by law; refunds for App Store purchases are handled by Apple under Apple's policies.
The free tier includes limited usage. We may change free-tier limits or subscription pricing; where changes affect paid subscriptions, we will provide notice as required by applicable law and the App Store rules.
Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, or abusive purpose
- Attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service or its underlying systems
- Use the Service to harass others or to generate harmful content
- Resell, redistribute, or commercially exploit the Service without our permission
Your Content
You retain ownership of the content you provide, such as your worry conversations and your dog's profile. You grant us a limited licence to store and process that content as needed to operate and provide the Service, including sending conversation content to our AI provider to generate responses. Intellectual Property
The Service, including its software, design, branding, and content (excluding your content), is owned by Captain Calm and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own personal, non-commercial use, in accordance with these Terms and the App Store's terms of service.
Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
Limitation of Liability
To the maximum extent permitted by law, Captain Calm will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of, or inability to use, the Service. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.
Termination
You may stop using the Service at any time by deleting the app. We may suspend or terminate your access to the Service if you breach these Terms or misuse the Service.
The Apple App Store
These Terms are between you and Captain Calm only, and not with Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for the app. To the extent permitted by law, Apple has no warranty obligation with respect to the app, and any claims relating to the app are our responsibility, not Apple's. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo, are not on any U.S. Government restricted-parties list, and that you will comply with any applicable third-party terms when using the app.
Governing Law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have exclusive jurisdiction, except where applicable consumer protection law gives you the right to bring proceedings in your country of residence.
Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date at the top. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
